Asylum is available to people in the United States who have a ''well-founded fear" of persecution. Asylum is a discretionary remedy. An asylum applicant must show that he or she has a fear of persecution and the fear is well-founded. Normally at least one central reason for the persecution is or will be race, religion, nationality, membership in a particular social group, or political opinion. The applicant also need to show that he or she is unable to return to the home country or country of last residence because of persecution or a well-founded fear of persecution.
